Heard the learned counsel for the petitioner and learned APP for the State.
The petitioner apprehends his arrest for the offences alleged under Sections 413 and 414 of the Indian Penal Code, registered in connection with Muffasil P.S.Case No. 49 of 2021.
As per allegation, the police apprehended three accused persons named in the FIR Chandan Kumar, Deepak @ Dipu Kumar Singh and Golu Kumar with a stolen motor-cycle. They disclosed the name of the present petitioner and apprised the police party that the petitioner has sold one theft motor-cycle to co-accused Karan Chaudhary.
The learned counsel for the petitioner has submitted that nothing was recovered from the possession of the present
Patna High Court CR. MISC. No.33551 of 2021(2) dt.04-04-2022 2/2 petitioner, rather the stolen motor-cycle, as per the seizure list, was recovered from the possession of co-accused person. There is nothing against him except the confessional statement of the co-accused. He has submitted further that the petitioner and Karan Chaudhary are co-villagers and the petitioner has some enmity with Karan Chaudhary. He has also submitted that the petitioner is a person of clean antecedents. Considering the above facts and circumstances, let the petitioner above-named, in the event of his arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Nawada in connection with Muffasil P.S.Case No. 49 of 2021, subject to the conditions as laid down under Section 438(2) Cr. P.C.
Office shall ensure that all defects are removed by the petitioner within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
