JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 12-07-2016 Herd learned counsel for the petitioner and the State. The petitioner apprehends his arrest in a case under Sections 363 and 366 of the Indian Penal Code, in which Section 376 of the Indian Penal Code was added, later on. The informant alleged that on 10.03.2016, he found his sister, namely, Aruna Kumari, missing from the room and a mobile, bearing no. 9060374763, lying on the ground. On enquiry, it was detected that the mobile belonged to this petitioner. Learned counsel submits that the victim has not named the petitioner in her statement recorded under Section 164 of the Cr.P.C., rather she has named one Sanjeet Kumar Rishi, as the person, who forcibly took her away and committed rape. No.25696 of 2016 (2) dt.12-07-2016 2/2 case, in the event of arrest or surrender before the court below within four weeks from today, the abovenamed petitioner be released on bail on furnishing bail bond of Rs.5000/- (Five thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Katihar in connection with Katihar Town (Sahayak) P.S. Case no. 193 of 2016, subject to the conditions as laid down under Section 438 (2) Cr.P.C. with the further condition that he would not physically absent for two consecutive dates at stretch, till two witnesses are examined, failing which the bail bonds would be cancelled.
