4.125 liters of English wine is said to have been recovered from the roof of the hotel of the petitioner. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the conscious physical possession of the petitioner. He has no concern with the seized wine. Several persons are living in the said premises on rent. He has been falsely implicated in the case by the police as he had failed to cough up the illegal demand made by them. There is violation of Section 100 Cr.P.C. He has no criminal antecedent.

Having regard to the facts and circumstances of the

Patna High Court CR. MISC. No.25116 of 2019(2) dt.19-04-2019 2/2 case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge-II-cum-Special Judge Excise Act, Kishanganj in connection with Bahadurganj P.S. Case No. 65 of 2019, subject to the condition as laid down under Section 438

(2) of the Cr.P.C.
