In this case, the petitioners are seeking anticipatory bail in connection with Srinagar P.S. Case No.63 of 2016, registered for the offence punishable under Sections 147, 148, 149, 341, 323, 324, 504, 506, 307 and 379 of the Indian Penal Code.
As per the F.I.R., while the informant making basket in front of his house, the accused persons armed with stick, iron rod and farsa came there and started abusing and assaulting the informant. When the wife of the informant came to save the informant, they also assaulted her and took away the golden chain.
Patna High Court Cr.Misc. No.33423 of 2017 (2) dt.24-07-2017 2/2 There is no specific allegation against the petitioner no.1. Allegation has been made against the petitioner no.2 of taking away the golden chain, which during investigation, found to be incorrect statement.
Looking to the facts and circumstances of the case, let the petitioners, namely, Jai Krishna Yadav @ Jai Krishna Kumar and Surendra Yadav, be released on anticipatory bail in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Madhepura, in connection with Srinagar P.S. Case No.63 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
