JUSTICE MADHURESH PRASAD ORAL JUDGMENT (Per: HONOURABLE THE CHIEF JUSTICE) Date : 04-05-2023 The petitioner is aggrieved with the seizure of cash and jewellery from her room when a raid was conducted under the Bihar Prohibition and Excise (Amendment) Act, 2018. There was contraband in the form of liquor recovered from the premises. The petitioner submits that there was no reason why the cash and jewellery was seized. Petitioner seeks release of the cash and jewellery.
The learned Government Advocate on instructions submits that the F.I.R. has been registered before the Special Court, Gaya and that the articles seized are also produced there.
Patna High Court CWJC No.6616 of 2023 dt.04-05-2023 2/2 In such circumstances, it is for the petitioner to approach the Special Court (Excise), Gaya under Section 451 of the Cr.P.C. It is made clear that if the petitioner files an application, the same shall be considered with notice to the respondent as expeditiously as possible.
