The application for grant of license of the petitioner was rejected thereafter, the petitioner approached the Commissioner of the Division in appeal. The Commissioner allowed the appeal and remitted back the matter to the District Magistrate, Patna vide remand order dated 26.04.2016. Thereafter, petitioner filed a representation before the District Magistrate, Patna on 09.01.2017 in connection with grant of gun license but the same is still pending at the level of District Magistrate, Patna.

Patna High Court CWJC No.8166 of 2019(2) dt.17-04-2019 2/2 Considering the aforesaid the writ petition is disposed of with direction to the District Magistrate, Patna, to examine the claim of the petitioner and pass appropriate order afresh on the application for grant of gun license of the petitioner within a maximum period of 60 days from the date of receipt/production of copy of this order.

While taking decision the District Magistrate, Patna is required to consider the rules as well as the judgment of the Division Bench reported in 2019 (1) PLJR 664. With the aforesaid, the writ petition stands disposed of.
