JUSTICE VINOD KUMAR SINHA ORAL ORDER 01-08-2019 This is an application for grant of anticipatory bail in connection with Kishanpur P.S. Case No. 40 of 2017, disclosing offences under Sections 406 and 420 IPC.
Allegation against the petitioner is that he has taken Rs.50,000/- from the complainant and thereafter, not returning the same and when the complainant sent a legal notice, he refused to pay the amount.
Submission of the learned counsel for the petitioner is that there is no supporting document to show that he has taken the amount from the complainant and the allegation is false and concocted.
Heard learned A.P.P. as well as learned counsel for the
Patna High Court CR. MISC. No.33139 of 2019(4) dt.01-08-2019 2/2 opposite party no.2 also, they have opposed the prayer for anticipatory bail on the ground that petitioner on the one hand mediating with the opposite party no.2 for returning the amount, on the other hand, he has filed this application. Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Supaul, in connection with Kishanpur P.S. Case No. 40 of 2017, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure. (Vinod Kumar Sinha, J) Sunil Shukla/- U T
