The petitioner seeks pre-arrest bail in connection with Sugauli P.S.Case No. 216 of 2016 registered under Sections 25(1-B)(a), 26 and 35 of the Arms Act.

It is submitted by the learned counsel for the petitioner that the manner in which the allegation has been made that the petitioner managed to escape in presence of the police is highly unbelievable. He submitted that out of enmity the coaccused Nawal Kumar gave his name as one of the persons accompanying him. As a matter of fact, on the date of occurrence the petitioner was in the village. He also submitted that the petitioner has no criminal antecedent.

No.1268 of 2018 (2) dt.19-01-2018 2/2 Having regard to the nature of allegation made in the FIR and the submissions made above, in the event of arrest or surrender before the court below within four weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Mothari, East Champaran in connection with Sugauli P.S.Case No. 216 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
