Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Hawai Adda P.S. Case No. 170 of 2019, registered for the offences punishable under Sections 406, 420, 467, 468 and 471 of the Indian Penal Code.

Earlier the anticipatory bail application of this petitioner was rejected vide order dated 05.03.2020 passed in Cr. Misc. No. 67750 of 2019. This is the second attempt. It is submitted on behalf of the petitioner that earlier

Patna High Court CR. MISC. No.22475 of 2020(2) dt.16-09-2020 2/2 bail application of petitioner was rejected solely on the ground of criminal antecedent, but as a matter of fact, this petitioner has got no criminal antecedent.

Counsel for the State submitted that petitioner along with other co-accused after receiving huge amount of money refused to register the sale deed, it is further submitted that this petitioner is member of land grabber and used to cheat people in the name of forged documents.

Considering the aforesaid facts and specific allegation of cheating against the petitioner, I am not inclined to enlarge the petitioner above-named on anticipatory bail. Accordingly, the same is rejected.
