The petitioner seeks bail in a case instituted for the offences under Sections 370, 373, 323, 341, 34 of the Indian Penal Code, 14 of the POCSO Act and 5 of Immoral Traffic Act. Prosecution allegation, in short, is that out of anger the informant left the house and met with a lady who sold her to the accused persons running brothel.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 9.1.2019. Chargesheet/prosecution report has been submitted in this case. There
Patna High Court CR. MISC. No.24600 of 2019(5) dt.22-08-2019 2/2 is no allegation of tampering of witnesses alleged against the petitioner. The statement of the victim has been recorded under Section 164 Cr.P.C. in which she has not named the petitioner. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-1st -cum- Special Judge, POCSO Act, Begusarai in connection with Mahila P.S. Case No. 30 of 2017.
