2. The petitioner seeks regular bail in connection with Mahila P.S. Case No. 55 of 2024 registered for the offence under Sections 64, 3(5) of the Bharatiya Nyaya Sanhita, 2023 and under Section 4/6 of the POCSO Act.

3. The victim in her statement recorded under Section 183 BNSS has stated about being subjected to sexual assault by one Shyam Kumar and not by the petitioner.

4. Learned counsel for the petitioner submits that petitioner is innocent and has not committed any offence. Petitioner is in custody since 27.11.2024. He further submits that no allegation has been attributed against the petitioner in the

Patna High Court CR. MISC. No.27216 of 2025(3) dt.06-08-2025 2/2 statement of the victim girl.

5. Learned A.P.P. for the State has vehemently opposed the prayer for bail.

6. Considering the aforesaid facts and circumstances, this application for regular bail is allowed.

7. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned concerned Court below, Purnia in connection with Mahila P.S.
