JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 17-12-2015 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in a case under section 307 and other allied sections of the Indian Penal Code. Learned counsel for the petitioner submits that there is a case and counter case and both sides have sustained injuries. He further submits that the injuries sustained by the prosecution side are simple in nature. He submits that the petitioner has no criminal antecedent and some of the co-accused has been granted bail.

Having regard to the facts and circumstances of the case, I am not inclined to grant anticipatory bail to the petitioner. His prayer for anticipatory bail is rejected. However, if the petitioner surrenders within four weeks from today, the trial court would dispose of the application preferably on the same day also taking into consideration that some of the co-accused have been granted regular bail.
