The petitioner apprehends his arrest in Turkaulia P.S. case No. 674 of 2015 under Section 304B/34 of the Indian Penal Code.
The mother of the deceased made allegation that her daughter was married to petitioner, Arjun Sahani, four years ago but petitioner was demanding Rs. 2 lac cash, a Hero Honda motor cycle and other articles. Due to non fulfillment of demand of dowry, the petitioner and others were assaulting the daughter of informant. The informant got information that her daughter was burnt to death inside the room.
The learned counsel for the petitioner submits that
Patna High Court Cr.Misc. No.27979 of 2016 (2) dt.02-09-2016 2/2 informant is not an eye witness of the occurrence and the allegation is false and concocted.
On the other hand, the learned counsel for the informant as well as the learned Additional Public Prosecutor opposed the prayer for anticipatory bail.
There is specific allegation against the petitioner that petitioner, being the husband, was torturing his wife and wife of the petitioner was burnt to death inside the room. Considering the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
