JUSTICE SANJAY PRIYA ORAL ORDER 10-10-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Ekma P.S.Case No. 172/2016 instituted for the offence under sections 147, 148, 149, 341, 323, 307, 504 and 379 of the Indian Penal Code. As per written report there is allegation against the petitioner of assaulting the informant with sword on his head. The injury report of the informant has been enclosed at Annexure 3 wherein the doctor has after CT Scan found facture of skull and opined that the injury may be grievous caused by hard and blunt substance or sharp cutting weapon.
As such, there is specific allegation against the petitioner. Therefore, this Court is not inclined to grant anticipatory bail to the petitioner.
The prayer for anticipatory bail of the petitioner stands rejected.
Patna High Court Cr.Misc. No.40318 of 2017 (3) dt.10-10-2017 The petitioner may surrender before the court below and make prayer for regular bail which shall be considered by the court below in accordance with law without being prejudiced by this order.
