1. Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.
2. This application, for grant of anticipatory bail, arises out of Sono Police Station Case No. 307 of 2024, disclosing offences under Sections 126(2), 115(2), 118(1), 109(1), 352, 351(3), 3(5), 351(2) of the BNS, 2023.
3. As per the FIR, on 19.09.2024, while the informant was at his wife's parental home, a monkey came on the roof and the children were making noise and throwing stones upon it. When the wife of the informant, namely, Babita Devi, prevented the children, the petitioner, along with other accused persons, started abusing and on the order of Chinta
Patna High Court CR. MISC. No.25595 of 2025(2) dt.07-05-2025 2/3 Devi, petitioner assaulted informant's wife with Tangi.

Learned Counsel for the petitioner submits that the petitioner has not committed any offence in the manner alleged and the occurrence has taken place on a trivial issue when the children were pelting stones on the monkey. The injury caused to the victim, i.e., informant's wife, is simple in nature as would be evident from Annexure P/2 of the Injury Report.

Having regard to the submissions made on behalf of the parties and taking into consideration the fact that the occurrence has taken place due to stone pelting by the children on the monkey and the injury caused to the informant's wife is simple in nature, I am inclined to grant the petitioner privilege of anticipatory bail.
6. This application is, accordingly, allowed.
7. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Jamui, in connection with Sono Police Station Case No. 307 of 2024, subject to the condition laid down under Section 438 (2)
