JUSTICE SATYAVRAT VERMA ORAL ORDER 20-05-2022 Heard learned counsel for the petitioners and learned APP for the State through video conferencing. The petitioners seek bail in a case registered for the offences punishable under Sections 30(a) of the Excise Act, 2018 and 411 of the I.P.C.

The learned counsel for the petitioners submits that the petitioners are in custody since 14.12.2021, they are persons with clean antecedent and charge-sheet has been submitted in this case.

Allegation is of total recovery of 192.45 litre of liquor from two auto, being driven by the petitioners, as detailed in the F.I.R.

Patna High Court CR. MISC. No.25423 of 2022(2) dt.20-05-2022 2/2 The learned counsel for the petitioners submits that petitioners, being driver of the vehicle, were not knowing which passenger had kept the liquor in their auto.

Learned A.P.P. opposes the bail application.

Considering the fact that the petitioners are in custody, they are persons with clean antecedent and chargesheet has been submitted in this case, the petitioners, abovenamed, are directed to be released on bail on their furnishing bail-bonds in the sum of Rs. 5,000/- (Rupees Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Imamganj P. S. Case No.198 of 2021.

The application stands allowed.
