S.C 3 ====================================================== CORAM: HONOURABLE MR. JUSTICE SANDEEP KUMAR ORAL ORDER 06-05-2025 Heard learned counsel for the petitioner and learned counsel for the State.
2. The petitioner has approached this Court for the following reliefs:- (i) For issuing a direction upon the respondent authorities to act in accordance with law and to investigate the Patori P.S. Case No.419 of 2024 in fair manner.
(ii) For issuing direction upon the
Patna High Court CR. WJC No.716 of 2025(2) dt.06-05-2025 2/3 respondents to bring the investigation to its logical end and to furthermore to arrest and sent up the accused persons for trial.
(iii) To bring the present case to its logical end as all the accused persons are roaming fear free in connivance with officials despite rejection of his bail order from this Court.
(iv) For providing an opportunity to the petitioner to represent his case as till date no concrete step has been taken by the police authorities for investigating the case and to give a fair hearing to the petitioner who has registered the present case.
(v) For directing the respondents to restrain themselves from lingering the matter too long in interest of justice and to submits its report as soon as possible.
(vi) For any other relief to which the petitioner is found entitled to in the facts of the case.
3. It has been submitted by the learned counsel for the petitioner that the father of the petitioner was murdered and he is being threatened by the criminals and the case is not being properly investigated.
4. Accordingly, the Superintendent of Police, Samastipur is directed to get the F.I.R. of Patori P.S. Case
Patna High Court CR. WJC No.716 of 2025(2) dt.06-05-2025 3/3 No.419 of 2024 properly investigated. He will also examine the feasibility of providing police protection to the witnesses including the petitioner under the Witness Protection Programme.
5. With the aforesaid direction and observation, this application stands disposed of.
