2. The petitioners have prayed for bail in connection with Suiya P.S. Case No.68 of 2025 registered for the offence punishable under Sections 191(2), 191(3), 190(1), 103(1), 351, 351(2) and 3(5) of the BNS.

3. The case of the prosecution, in short, is that altogether 11 persons being armed with lathi, danda, knife and pistol arrived and started attacking the informant. It is further alleged that one Habib Ansari exhorted to assault and on this, one Firdos Ansari assaulted with a knife to the father of the informant due to which, he died.

4. Learned counsel appearing on behalf of the petitioners has submitted that the name of these petitioners is not there in the FIR. There name has surfaced during investigation in the confessional statement of co-accused Akhtar Ansari. Learned counsel for the petitioner has submitted that Akhtar Ansari has given his confessional statement in a different case wherein he has named these two petitioners also. Akhtar Ansari is not named in this case. Learned counsel for the petitioners has submitted that at belated stage, statement of Akhtar Ansari was recorded with a view to implicate some more persons. From perusal of the FIR it is clear that main thrust of allegation is against Firdos. It has further been submitted that Akhtar Ansari has been granted bail by the learned Co-ordinate Bench of this Court vide Cr. Misc. No.

23819 of 2026 and one Md. Rajjak Ansari has been granted bail by this Court vide Cr. Misc. No. 28242 of 2026. The case of these petitioners stands on better footing. It has further been submitted that the petitioners are men of clean antecedent and they are in judicial custody since 29.01.2026.

5. The application for bail is opposed by learned APP for the State and learned counsel for the informant. Learned counsel for the informant has conceded that the main thrust of

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) each with two sureties of the like amount each to the satisfaction of the court of learned Chief Judicial Magistrate, Banka in connection with Suiya P.S. Case No.68 of 2025.
