====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 04-09-2020 Heard learned counsel for the petitioner and the counsel appearing on behalf of the State.

Petitioner is apprehending arrest in connection with Kotwali P.S. Case No. 348 of 2019 for the offence under sections 406, 420, 467, 468, 471, 170, 120(B)/34 of the Indian Penal Code 20,20 N.D.P.S. Act.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent.

Allegation against this petitioner is that he was involved in inducing the people and extorting money for providing job. There is allegation that the person who paid Rs. 7 lacs neither got job nor his money was refunded. Learned counsel submits that the petitioner was not named in the FIR as the case is only registered against Brajesh Singh @ Bambam Singh. Later on, the name of the petitioner

Patna High Court CR. MISC. No.22534 of 2020(2) dt.04-09-2020 2/2 surfaced on the confessional statement of Gautam Yadav and Mukesh Yadv whose name was disclosed by Brajesh Singh @ Bambam Singh.

Considering the fact that the petitioner was neither named in the FIR nor disclosed by the person named in the FIR, the Court is inclined to grant anticipatory bail to the petitioner, let the petitioner, named above, in the event of arrest or surrender before the court below within a period of four weeks from the date of communication of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Munger, in connection with Kotwali P.S. Case No. 348 of 2019 subject to the condition as laid down under section 438(2) of the Cr.P.C. with further condition that the petitioner shall deposit Rs. 25000/- cash to the court below and the amount deposited by the petitioner shall abide by final outcome of the pending criminal case.
