1. Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.

2. This application, for grant of anticipatory bail, arises out of Islampur Police Station Case No. 65 of 2025, dated 05.02.2025, disclosing offences under Sections 192(2)/191(3)/190/61(2)/126(2)/115(2)/352/117(2)/109/6 1(2)/126(2)/115(2)/352/117(2)/109/303(2)/74 of the Indian Penal Code.

The prosecution case, as per the First Information Report, is that on 05.02.2025, at around 04:30 PM, when the informant's son was returning from coaching and reached near Sunil's house, the petitioner, along with other coaccused persons, were having party. Upon seeing the informant's son, they started abusing him and when the

Patna High Court CR. MISC. No.24947 of 2025(2) dt.05-05-2025 2/3 informant's son objected, co-accused Sudhir Kumar threw him into the drain due to which his hand got broken. Upon hearing the noise, the informant came to rescue his son then the co-accused Deepak Kumar and Dilip Kumar assaulted him with axe and iron rod, respectively, causing injuries. It has further been alleged that when the informant's wife intervened, the petitioner and other coaccused persons snatched golden mangalsutra and earring and also pulled the informant's wife down with her hair.

4. Learned counsel for the petitioner submits that both the parties are agnates and the petitioner has falsely been implicated in the present case due to land dispute between them. He next submits that allegation of assault is not against the petitioner, who is a lady. He further submits that allegation that the petitioner snatched golden mangalsutra and earrings is nothing but super-addition.

5. Having regard to the submissions made on behalf of the parties and taking into consideration the fact that both the parties are agnates having land dispute and the petitioner is a lady, I am inclined to grant the petitioner privilege of anticipatory bail.

6. This application is, accordingly, allowed.

7. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Hilsa, Nalanda, in connection with Islampur Police Station Case No. 65 of 2025, subject to the condition laid down under Section 482 (2) of the Bhartiya Nagrik Suraksha Sanhita, 2023.
