The petitioner apprehends his arrest in Khagaria (Gangour) P.S. Case No. 802/2015, registered for the offences punishable under Sections 302 and 34 of the Indian Penal Code and Section 27 of the Arms Act.
The informant named the petitioner along with other accused persons and alleged that Umesh Singh fired at the husband of the informant and thereafter the petitioner and other accused persons made indiscriminate firing.
Learned counsel for the petitioner submits that the deceased was a veteran criminal and he was killed by unknown accused persons, but the petitioner has falsely been implicated in this case.
Patna High Court Cr.Misc. No.31642 of 2016 (3) dt.19-10-2016 2/2 Learned counsel for the informant as well as learned A.P.P. opposed the prayer for anticipatory bail of the petitioner and submitted that anticipatory bail petition of co-accused Umesh Singh has already been rejected.
Considering the facts aforesaid and the fact that there is specific allegation against the petitioner that petitioner also fired at the deceased husband of the informant, I am not inclined to enlarge the petitioner above-named on anticipatory bail. Accordingly, the same is rejected.
