Learned counsel for the petitioners is directed to remove the defect(s) as pointed out by the office within a period of four weeks.
The petitioners are apprehending their arrest in a case registered under Sections-323, 324, 325, 307 and 34 of the Indian Penal Code.
Prosecution case in short is that while the informant and her son were making hut for supervision of their crops on

No.26029 of 2022(2) dt.14-11-2022 2/3 government land, the accused/petitioners came and started assaulting them with lathi-danda, tangi and khanti, as a result of which, the informant's son sustained injuries on his fingers and head and the informant's husband also sustained injuries. It is submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. General and omnibus allegation has been made against the petitioners. There is no specific allegation against the petitioners. There is delay of five days in instituting the case. The delay in instituting the case has not been explained by the prosecution.
Learned counsel for the State submits that the petitioners are named in the FIR.
Considering the aforesaid facts and circumstances, let the petitioners named above, in the event of arrest/surrender before the learned court below within a period of twelve weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Smt. Neha Tripathi, learned Judicial Magistrate-Ist Class, Gaya in connection with Magadh University P.S. Case No. 140 of 2020 subject to the
Patna High Court CR. MISC. No.26029 of 2022(2) dt.14-11-2022 3/3 conditions as laid down under Section-438(2) of the Code of Criminal Procedure.
