The petitioner is apprehending his arrest in a case registered under Sections 406, 409, 420, 467 & 468 of the Indian Penal Code. Allegedly, the accused petitioner misappropriated the government money meant for construction of Gasifier-cum-rice Mill. It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner happens to be Chairman of the PACS. The petitioner is Chairman of Bharathi PACS. The allegation against the petitioner is that he was sanctioned Rs. 31.14 lacs for construction of Garifiercum-Rice Mill by the government which was not completed by him. A Counter affidavit has been filed on behalf of O.P. No. 2 Bihar State Civil Supplies Corporation Ltd. Let the same be kept on record. Considering the aforesaid facts and circumstances of the case, the petitioner, above named, in the event of arrest or surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Darbhanga in connection with Simri P.S. Case No. 47 of 2020 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
