JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 16-08-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Sikty P.S. Case no. 105 of 2015, registered under Section 304-B/34 of the Indian Penal Code.

The accusation is of killing of sister of the informant by her husband and other in-laws due to non-fulfillment of demand of motorcycle, cash and other articles in dowry. Learned counsel for the petitioner submits that petitioner happens to be mother-in-law of the deceased. Further submission is that, in fact, the deceased, sister of the informant, has gone near the cow for giving fodder, but unfortunately cow dashed the deceased, who fell down on the 'Naad' and sustained injury at her head. The husband of the deceased is in custody since 09.08.2017. Further submission is that the petitioner, being the mother-in-law of deceased,

Patna High Court Cr.Misc. No.15822 of 2017 (5) dt.16-08-2017 2/2 has falsely been implicated in this case.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Araria in connection with Sikty P.S. Case No. 105 of 2015, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
