ANJANA MISHRA ORAL ORDER 20-12-2016 Heard learned counsel for the petitioners, informant and learned counsel appearing on behalf of the State.
Today, a supplementary affidavit has been brought on record, annexing certain documents with an effort to prove that the girl was unfit mentally. The petitioners apprehend their arrest in connection with Dariyapur P.S. Case No. 122 of 2016 for the offences registered under Sections 302, 201 and 34 of the Indian Penal Code.
Diary in the present case has also been produced and there is sufficient material to indicate that the family of the victim girl had been indulging in certain acts in order to prevent the production of the victim girl, who had since attained the majority before the Court of Chief Judicial Magistrate, Saran at Chapra.
Having considered the materials which have come on record in the case diary, I am not inclined to grant anticipatory bail to the petitioner nos. 1 & 2. Accordingly, their prayer for anticipatory bail is rejected.
So far as petitioner no. 3, namely, Monu Devi @ Minu Devi is concerned, (wife of Tribuhwan Singh, D/o petitioner no. 1) there appears to be no cogent material against her, let the petitioner no. 3, namely, Monu Devi @ Minu Devi, in the event of her arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with
two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate IVth, Saran at Chapra in connection with Dariyapur P.S. Case No. 122 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
