JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 20-09-2017 Heard the learned counsel for the petitioners as well as the learned A.P.P. for the state.

In this application for anticipatory bail the petitioners apprehend their arrest in connection with Khagaria (Chitraguptnagar) P.S. Case No. 342 of 2017 for the offences punishable under sections 341, 323, 354, 379, 504, 506, 307 and 34 of the I.P.C.

Allegedly, the petitioners and other co-accused entered into the house of the informant being armed with lathi and danda and after smoking ganja they directed to vacate the house and on protest they started assaulting the informant and her daughter and further Praveen Yadav, Devendra Yadav @ Manish Yadav (petitioner no.2) misbehaved with her and snatched gold

Patna High Court Cr.Misc. No.43952 of 2017 (2) dt.20-09-2017 2/2 earring valued Rs. 15,000/-. Bambam Yadav and petitioner no.1 took away cash of Rs. 20,240/- and when Nageshwar Yadav and Sudhir Yadav came to protest they were also assaulted by them. Submission is of false implication and that there is case and counter case, the house in question is a flat which has been transferred by uncle of the petitioners and steps are going on in the Housing Board, the informant is the distant relation and she wants to grab the house in question, the injury caused to Nageshwar Yadav is simple caused by hard and blunt object, no other injury report is available and as such the petitioners deserve sympathetic consideration.

The learned A.P.P. opposes the prayer for pre-arrest bail of the petitioners.

In the facts and circumstances stated above, the petitioners, in case of their arrest or surrender within a period of four weeks from the date of receipt/production of a copy of this order, shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of C.J.M, Khagaria in connection with the aforementioned case, subject to the condition as laid down under section 438 (2) of the Cr.P.C.
