JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 11-04-2019 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Arrah (Town) P.S. Case No. 130 of 2019 for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he is in custody since 08.03.2019. He further submits that in the instant case total 50 litres of Mahua liquor and 7 litres of foreign liquor were seized. He submits that the seizure list was not prepared as per the mandatory provision prescribed under Section 100 of the Cr.P.C.
Considering the fact that the petitioner has got no criminal antecedent, the petitioner, named above, is directed to
Patna High Court CR. MISC. No.23545 of 2019(2) dt.11-04-2019 2/2 be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Special Judge, Excise Act, Arrah in connection with Arrah (Town) P.S. Case No. 130 of 2019 (Excise Case No. 437 of 2019).
