JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 18-01-2021 Heard learned counsel appearing on behalf of the petitioners and learned counsel appearing on behalf of the State. The petitioners, who are father and mother of coaccused, Rajesh Thakur, are in custody in connection with Arer P.S. Case No. 76 of 2019 for the offence under Section 302/34 of the Indian Penal Code.

Learned counsel for the petitioners submits that the petitioners have got no criminal antecedents. It is alleged that Rajesh Thakur has sexually exploited the daughter of the informant, namely, Najani Khatoon and thereafter the petitioners decided to keep Najani Khatoon as daughter-in-law of the petitioners and later on,

Learned counsel appearing on behalf of the petitioners submits that post mortem report of the deceased does not disclose any external injury. Petitioners are in custody since 13.12.2019 .

Considering the fact that the petitioners are father and mother of the co-accused Rajesh Thakur and there is no external injury as per post mortem report, the Court is inclined to grant bail to them. The petitioners, named above, are directed to be released on bail on furnishing bail bonds of Rs.50,000/- (Rupees fifty thousand) each with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Benipatti, Madhubani in connection with Arer P.S.
