The petitioner No.5, Sanjay Singh, has filed this modification petition for modification in the order dated 14.12.2015 passed in Cr. Misc. No. 50636 of 2015. The petitioner along with six others were granted anticipatory bail vide order dated 14.12.2015 passed in Cr. Misc. No. 50636 of 2015 on condition that petitioner shall deposit Rs. 4600/- within four weeks from the date of order. The petitioner deposited Rs. 14,278/- on 07.06.2016. The petitioner deposited the amount with compounding charges.
Considering the fact that petitioner has already deposited the amount, it is observed that if the petitioner, above
Patna High Court Cr.Misc. No.27982 of 2016 (2) dt.23-11-2016 2/2 named, surrenders in the court below, i.e., Sri N. P. Singh, learned Judicial Magistrate, 1st class, Bettiah, West Champaran, in Nautan P.S. case No. 218 of 2015, the learned court below shall consider the prayer for regular bail of the petitioner taking into consideration that he was granted anticipatory bail by this court and he deposited the amount, although after stipulated date, and dispose of the bail petition, preferably, on the same date. With this observation, the modification petition is disposed of.
