The petitioners seek regular bail in connection with Jainagar Police Station Case No. 30 of 2020, registered for the offences punishable under Sections 498-A/494/34 of the Indian Penal Code and Section 37 (c) of the Bihar Prohibition and Excise Act, 2016.

The allegation, as per the First Information Report, is that the petitioner no. 1, being the husband of the informant along with petitioner no. 2 being the elder brother of petitioner no. 1,assaulted the informnt and ousted her from her

Patna High Court CR. MISC. No.26843 of 2020(2) dt.16-10-2020 2/3 matrimonial home. It has further been alleged that the petitioner no. 1, husband of the informant, has performed second marriage.

Learned Counsel for the petitioners submits that the petitioners have not committed any offence in the manner alleged and they have falsely been implicated in this case. He further submits that the marriage of the petitioner no. 1 and the infrmant was solemnized about eight years back and there is some marriage discord between them. He further submits that no injury has been caused to the informant and the petitioners are in custody since 27.01.2020.

Having heard learned Counsel for the parties and taking into consideration the materials on record and the fact that the petitioners are in custody since 27.01.2020, I am inclined to grant regular bail to the petitioners. This application is allowed.

Accordingly, let the petitioners, above named, be released on bail, upon furnishing bail bonds of Rs. 20,000/- (twenty thousand) each with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge -cum- Special Judge, Excise, Madhubani, in connection with Jainagar Police Station Case No. 30 of 2020.
