JUSTICE BIRENDRA KUMAR ORAL ORDER 10-08-2017 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case registered under Sections 323,341, 504, 307, 147, 148, 149 of the Indian Penal Code The petitioners are the members of Scheduled Tribe. The allegation is that the informant & others, who are members of the Scheduled Caste, are BPL Card holders, went for compromise with the petitioners and during course of that occurrence of assault etc. took place.
Considering general and omnibus allegation as well as nature of allegation, let the above named petitioner, in the event of his arrest/surrender in the court below within a period of thirty
Patna High Court Cr.Misc. No.36026 of 2017 (2) dt.10-08-2017 2/2 days from the date of receipt of the order be released on bail on furnishing bail bond of Rs. 10,000/( ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea in connection with Dhamdaha P.S.Case No. 215 of 2016 (G.R.No. 3987 of 2016),subject to the conditions as laid down u/s 438(2) Cr.P.C. as well as condition that the petitioners shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bonds of the petitioners.
