JUSTICE RAJENDRA KUMAR MISHRA ORAL JUDGMENT Date: 09-03-2015 ------------- The present contempt application has been filed asserting the non compliance of the order dated 03.02.2010 passed in C.W.J.C. No.1859 of 2010, which was disposed of with the following observations/directions:

"In the above circumstances, the learned counsel for the petitioner submits that although the petitioner had filed a representation for redressal of his grievances, however, for expeditious disposal of the pending claims as raised in this writ application, the petitioner proposes to file a fresh representation

Patna High Court MJC No.2778 of 2010 dt.09-03-2015 2/3 before the Registrar, Lalit Narayan Mithila University, Darbhanga (respondent no.4). In case such a representation is filed stating the details of the unpaid claims as also enclosing the copy of the relevant documents, if any, in support of such claims along with the certirfied copy of the present order within a period of six weeks, respondent no.4 shall consider the grievances of the petitioner as raised in his representation and dispose it of in accordance with law expeditiously, preferably within a period of four months on receipt of such representation, so that the grievances of the petitioner raised in his representation could be settled and the admitted dues, if any, could also be paid with statutory interest without further delay."

2. Learned counsel appearing on behalf of L.N. Mithila University, Darbhanga, in presence of the learned counsel appearing on behalf of the petitioner, submits that in compliance of the order dated 03.02.2010 passed in C.W.J.C. No.1859 of 2010, which is under contempt, all the admitted dues, after considering the representation of the petitioner by the concerned opposite party(s), have been paid to the petitioner by the concerned Univeristy.

3. On the other hand, learned counsel appearing on behalf of the petitioner submits that the concerned University has illegally adjusted 130 days of the strike period from the Earned Leave of the petitioner and similarly in Group Insurance, the interest has been paid

Patna High Court MJC No.2778 of 2010 dt.09-03-2015 3/3 only up-to the period of 2001-2002, while the petitioner was entitled for the interest on the same up-to the year 2014 and prays that the petitioner may be permitted to raise such grievance before the appropriate forum in accordance with law.

4. In that view of the matter, this contempt application stands disposed of granting liberty to the petitioner to raise his grievance, as aforesaid, before the appropriate forum in accordance with law.
