The petitioner seeks bail in Mednichowki P.S. Case No. 118 of 2020, registered for the offence punishable under Sections 452, 354(A), 354(B) and 506 of the Indian Penal Code. As per the FIR, this petitioner tried to molest the informant.

It is submitted on behalf of the petitioner that section 354(B) is not applicable as there is no allegation against this petitioner to assault or use of criminal force with intent to disrobe the informant. Petitioner is next door neighbour of the informant and due to old enmity petitioner has been falsely implicated in this case. Petitioner claims clean antecedent and he is in custody since 21.12.2020. Chargesheet has already been submitted.

No.35259 of 2021(2) dt.08-12-2021 2/2 Considering the facts and circumstances of the case and clean antecedent, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate Ist, Lakhisarai in connection with Mednichowki P.S. Case No. 118 of 2020.
