The petitioner seeks bail in a case registered under Sections 379, 420, 467 of the Indian Penal Code and 66(D) of I.T. Act.
Allegation against the petitioner is of cheating innocent persons.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 24.01.2019 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. There is no substantive evidence to suggest the implication of the petitioner in the present case. It is further submitted that the petitioner is ready to deposit an amount of Rs.3 lacs in the court below in four equal
Patna High Court CR. MISC. No.23858 of 2019(3) dt.07-05-2019 2/2 instalments within a period of four months, which will be subject to the final disposal of the case.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, petitioner is directed to deposit an amount of Rs.3 lacs in the court below in four equal instalments within a period of four months, which will be subject to the final disposal of the case. Let the petitioner, above named, be released on provisional bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 1st, Jehanabad in connection with Jehanabad P.S. case No.57 of 2019. If the petitioner deposits the aforesaid amount in the court below, the provisional bail granted to the petitioner will be confirmed by the court below itself.
If the petitioner fails to do so, the court below will be at liberty to cancel the provisional bail granted to the petitioner. Narendra/- (Sudhir Singh, J) U T
