Petitioners apprehend their arrest in connection with Banmankhi P.S. Case No. 09 of 2018 registered for the offences punishable under Sections 341, 323, 325, 307, 379 and 34 of the Indian Penal Code.

Allegation against the petitioners is of assault to the son of the informant, causing injury.

Submission of learned counsel for the petitioners is that prior to that daughter of petitioner No.2 has lodged a case against the informant and his son with respect to having obscene photograph of daughter of petitioner No.2 and making it viral. Further submission is that informant has got a report submitted

Patna High Court Cr.Misc. No.24368 of 2018 (2) dt.03-05-2018 2/2 that son of the informant having brain hemorrhage and for that Medical Board was constituted and it was opined that it was not a case of brain hemorrhage.

Heard learned APP, who has opposed the prayer for anticipatory bail.

Having heard both sides and in the facts and circumstances, let the petitioners, above named, surrender and on their so surrendering they shall be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-I, Purnea, in connection with Banmankhi P.S. Case No. 09 of 2018, subject to the conditions under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
