This application for grant of anticipatory bail arises out of Buddha Colony P.S. Case No. 151/2015, disclosing offences under Sections 147, 148, 149, 323, 353, 307, 153(A), 153, 504, 506, 337, 283 of the Indian Penal Code and 27 of the Arms Act.
From the First Information Report it appears that two religious groups had clashed against each other and indulged in rioting. It is also alleged that some of the accused persons started pelting stones and opened fire on the police party. Learned counsel, appearing on behalf of the
Patna High Court Cr.Misc. No.29131 of 2016 (2) dt.20-08-2016 petitioners, has submitted that 32 persons have been named in the F.I.R. and 70-80 persons, who have not been named, had also been made accused. He has submitted that there is no specific allegation of assault against these petitioners, who have no criminal antecedent.
Considering the nature of allegation, this application is allowed.
Let the petitioners, abovenamed, in the event of their arrest/ surrender before the court below within six weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Patna in connection with Budha Colony P.S.Case No. 151/2015, subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioners shall present themselves before the police/ Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
