2. The petitioners are apprehending their arrest in Revelganj P.S. Case No. 153 of 2024 registered under Sections 363/ 366(A) of the Indian Penal Code.
3. As per the prosecution story, the petitioners along with other co-accused persons are said to have kidnapped the minor daughter of the informant with intention to marry her.
4. Learned counsel for the petitioner has drawn my attention towards the statement of the victim recorded under
Patna High Court CR. MISC. No.25530 of 2025(5) dt.07-10-2025 2/3 Section 164 of the Cr.P.C. Learned counsel for the petitioners has submitted that the victim did not name the petitioners. She named two accused persons i.e. Ashok Rai and Budhan Rai alleging therein that they kidnapped her. He fairly submits that in paragraph-5, the victim has stated that Sanjay Rai (petitioner no. 2), Bhuwan Rai and Jitendra Rai have attempted to commit misdeed with her.
5. Learned APP for the State opposed the prayer for bail of the petitioners.

Considering the aforesaid facts and circumstances that the victim has not whispered the name of petitioner no. 1, let the petitioner no. 1, namely, Pappu Rai @ Bhuwar @ Bhuwar Rai @ Bhuwan, above named, in the event of arrest/surrender before the learned court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Saran at Chapra in connection with Revelganj P.S. Case No. 153 of 2024, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure/ 482(2) of the BNSS, 2023.
7. So far as petitioner no. 2 is concerned, the victim has
Patna High Court CR. MISC. No.25530 of 2025(5) dt.07-10-2025 3/3 named him in her statement recorded under Section 164 of the Cr.P.C., so, he does not deserve the privilege of anticipatory bail. Accordingly, the prayer for anticipatory bail on behalf of the petitioner no. 2 is rejected.
