This application for grant of anticipatory bail arises out of Birpur P.S. Case No. 34 of 2016, disclosing offences under Sections 409/34 of the Indian Penal Code.

The petitioner has been made accused as she was the Secretary of Middle School, Babhangama in the district of Begusarai. As allegedly, the Headmaster and the Secretary of the School, has misappropriated, an amount of Rs. 25,99,133/- which was required to be utilized for the purpose of construction of School building.

Learned counsel appearing on behalf of the petitioner has submitted that she is a lady and there is no chance that she would flee from the course of investigation or trial. It has further

Patna High Court Cr.Misc. No.32300 of 2016 (2) dt.29-08-2016 2/2 been submitted that co-accused namely, Ramchandra Paswan has been granted anticipatory bail by this Court by an order dated 23.07.2016 passed in Criminal Miscellaneous Case No. 30467 of 2016.

Considering the submission as above, this application is allowed.

Let the petitioner, above-named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Begusarai in connection with Birpur P.S. Case No. 34 of 2016, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
