JUSTICE DINESH KUMAR SINGH ORAL ORDER 05-09-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341,323 and 307/34 of the Indian Penal Code and section 27 of the Arms Act. The prosecution case is that the neighbour of the informant namely Jitendra Paswan was carrying sand on tractor when the petitioner resorted to fire causing injury on the right side of the waist of Jitendra Paswan. The informant saw the occurrence and lodged the FIR. The motive for the alleged occurrence is nonpayment of money demanded as extortion. It is submitted by the learned counsel for the petitioner that the injured has not supported the accusation against the petitioner and filed an affidavit to that effect before the learned

Keeping in view of the nature of accusation, this court is not inclined to grant anticipatory bail to the petitioner. Let the learned court below consider the prayer for regular bail of the petitioner without being prejudiced by this order in case the petitioner surrenders within six weeks from today in connection with Karpi P.S. Case No. 20 of 2016 pending in the court of learned C.J.M. Arwal.

This application is disposed of with the aforesaid observation/direction.
