2. Petitioners apprehend arrest in a case registered for the offence punishable under sections 363, 366(A)/34of the Indian Penal Code and under section 8 of POCSO Act.

3. As per the prosecution case, these petitioners kidnapped 13 years old minor daughter of the informant.

4. It is submitted on behalf of the petitioners that the the victim in her 164 Cr.P.C. statement has stated that out of her own sweet will she had gone with co-accused Ajay Chaudhary. Petitioner no.1 is co-villager, petitioner no. 2 is elder brother

Patna High Court CR. MISC. No.27367 of 2024(3) dt.15-07-2024 2/2 and petitioner no. 3 is father of said co-accused Ajay Chaudhary. Petitioners claim clean antecedent.

5. Considering the aforesaid statement of the victim prayer for bail of all the petitioners is allowed. In the event of arrest/surrender within six weeks from today, let these petitioners, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Special Judge, POCSO Act , Samastipur, in Tajpur Police Station Case No. 644 of 2023, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
