2. In the instant petition, the petitioner has prayed for the following reliefs:

"That this writ application is being filed before this Hon'ble Court for issuance of an appropriate writ / writs, direction/directions commanding the respondents authorities to pay Rs.5,11,142/- (Five lacs Eleven thousand one hundred and forty two) with interest to the petitioner who worked against the post of contractual clerk after his retirement in the office of Circle Officer, Punpun for the period of 1 year 4 months and 24 days apart from 3 years earlier."

3. 3rd respondent/District Magistrate, Patna has not taken any decision as to whether petitioner is entitled for salary for a period 1 years 4 months and 24 days apart from three years service rendered by the petitioner.

4. Therefore, the 3rd respondent is hereby directed to peruse the petitioner's representation and relevant Rules for grant of monetary benefits, if petitioner is otherwise eligible.

5. Such decision shall be taken within a period of one month from the date of receipt of copy of this order, failing which the petitioner is entitled to interest at the rate of 12% per annum in the light of Apex Court decision in the case of Vijay L. Mehrotra Vs. State of U.P. and others, reported in (2001) 9 SCC 687.

6. The writ petition stands disposed of.
