The petitioner seeks regular bail in connection with Sabour (Goradih) P.S. Case No. 479 of 2023, S.T. No. 123/2024 dated 31.08.2023, registered under Sections 302/120B and 34 of the Indian Penal Code.

As per the prosecution case, the petitioner is suspected in the killing of the deceased. It has come during the investigation that the deceased used to smoke ganza regularly and used to sit with anybody for smoking ganza. During investigation, petitioner presence was found in that area. 4.
Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. The
Patna High Court CR. MISC. No.29319 of 2024(3) dt.31-07-2024 2/2 name of the petitioner has transpired in this case on the basis of suspicion. No incriminating material has been recovered from the petitioner. There is no material to connect the petitioner with the crime. The petitioner has no criminal antecedent and he is in custody since 21.12.2023.

Learned A.P.P. for the State has opposed the prayer for bail.

Considering the facts and circumstances of the case and also period of custody, this bail application is allowed. 7.
Let the petitioner above named, be granted bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge, 10th Bhagalpur in connection with Sabour (Goradih) P.S. Case No. 479/2023, S.T. No. 123/2024, subject to the condition that the petitioner shall cooperate in the trial and shall be represented through his lawyer or himself.
