This is an application for grant of anticipatory bail in connection with Chandi P.S. Case No. 110 of 2017 registered for the offence punishable under Sections 341, 323, 325, 379, 354, 504 and 506 of the Indian Penal Code.
The allegation against the petitioner is that he used to harass the grandson of the informant by trying to do unnatural things with him and subsequently upon the prosecution side complaining about the same, the petitioner had engaged in assault with fists and punches resulting in injury to the informant.
The learned counsel for the petitioner submits that since the prosecution side are engaged in ganja business and the petitioner is objecting to the same, the petitioner has been
Patna High Court Cr.Misc. No.1274 of 2018(2) dt.12-02-2018 2/2 falsely implicated in the present case. It is stated that the petitioner is a retired havildar of the Indian Army and the petitioner has a clean antecedent.
Having regard to the facts and circumstances of the case, I deem it fit and proper to admit the petitioner herein to the privilege of anticipatory bail, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-XII, Bhojpur, Ara in connection with Chandi P.S. Case No. 110 of 2017 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
