In this case, the petitioner is seeking anticipatory bail in connection with Bypass P.S. Case No.89 of 2016, registered for the offence punishable under Section 409 of the Indian Penal Code.

Allegation has been made that a letter dated 29.07.2016 was written by Indu Kumari, Block Education Officer, informing all the Panchayat Sachivs who have not submitted the provisional merit list and final merit list of Panchayat Teachers for verification of the certificate by the Vigilance Department, will face criminal case. Learned counsel for the petitioner submits that the petitioner was transferred from Marachi to Mokama in the year 2011 as well as no such letter was addressed to the petitioner for the purposes of remitting the aforesaid certificates for verification and as such, the petitioner had not submitted the same. Looking to the aforesaid facts, let the petitioner, namely, Uma Shankar Ravidas @ Uma Shankar Prasad, be released on anticipatory bail in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the A.C.J.M., Patna City, Patna, in connection with Bypass P.S.
