In the present appeal, the appellant is seeking bail in POCSO Case No. 34 of 2018 arising out of Govindpur P.S. Case No. 40 of 2018 registered for offence punishable under Sections 341, 342, 323, 379, 354 (G), 354, 354 (B)/34 of the Indian Penal Code and Sections 4, 8, 12 of POCSO Act and Section 3 (I) (r), 3 (I) (w) of SC/ST Act.
Allegation against the appellant is to have tried to outrage the modesty of the victim and assaulted her husband, however, counsel for the appellant submit that he is the young person and his brother has given an undertaking that in future he will not indulge in such activity. He further submits that the appellant is in judicial custody since 1.03.2020. Considering the facts and circumstances of the case,

APP (SJ) No.1525 of 2020(6) dt.22-12-2020 2/2 the appellant, above-named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of 1st Additional District and Sessions Judge, Nawada in connection with POCSO Case No. 34 of 2018 arising out of Govindpur P.S. Case No. 40 of 2018 with a condition that if the appellant, after his release in this case, is again found involved in similar nature of cases then the concerned court would be at liberty to take steps for cancellation of his bail bonds.
