2. The petitioner seeks quashing of FIR of Ghanshyampur P.S.Case No.167 of 2011 registered for the offence under Sections 406, 409, 420, 457, 468 and 471/34 of the IPC.

On the report of Block Development Officer, Ghanshyampur which is based on letter no.3599/G Gra dated 23.09.2011 of DRDO, Darbhanga, a police case vide Ghanshyampur P.S.Case No.167 of 2011 was registered against six persons including petitioner. The matter was investigated and police submitted chargesheet on 09.02.2014. The SDM, Biroul as per order dated 17.02.2014 took cognizance under Sections 406, 409, 420, 466, 468 and 471/34 of the IPC and ordered for issuance

Patna High Court Cr.Misc. No.30075 of 2014 (3) dt.05-07-2017 2/2 of summons against four persons excluding this petitioner as the police kept further investigation pending against him. The FIR relates to irregularities in his execution of three MANREGA schemes. The FIR was registered after due enquiry by three committees. The case is still under investigation and so, the petitioner has no locus standi to challenge the FIR.

4. In view of the aforesaid facts, I do not find any merit in this criminal miscellaneous application. Accordingly, the petition is dismissed.
