JUSTICE MOHIT KUMAR SHAH ORAL ORDER 14-07-2021 The present petition has been taken up for consideration through the mode of Video conferencing in view of the prevailing situation on account of COVID 19 Pandemic, requiring social distancing.

Heard the learned counsel for the petitioner and the learned APP for the State.

The present petition has been filed for modifying the order dated 04.12.2020, passed in Cr. Misc. no. 28853 of 2020 to the extent that the time granted by this Court to the petitioner to surrender before the learned court below be extended by a further period of four weeks from today.

No.35854 of 2021(2) dt.14-07-2021 2/2 The learned counsel for the petitioner has submitted that on account of prevailing situation due to Covid 19 Pandemic, the petitioner could not surrender within the time stipulated by this Court by the aforesaid order dated 04.12.2020, hence the time for surrendering be extended.

The learned APP for the State has got no objection. Having regard to the facts and circumstances of the case and considering the averments made in the present petition, the time granted to the petitioner to surrender vide aforesaid order dated 04.12.2020 is extended by a further period of four weeks from today, however it is clarified that all other conditions stipulated in the order dated 04.12.2020 shall remain the same.

The petition stands allowed with the aforesaid modification in the order dated 04.12.2020, passed in Cr. Misc. no. 28853 of 2020.
