JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 23-08-2023 Heard learned counsel for the petitioner, learned counsel for the informant and learned APP for the State. The petitioner has prayed for bail in a case instituted for the offence under Sections 302, 201, 34 of the Indian Penal Code.
It is a case of commission of murder of the informant's father, namely, Radheshyam Chandrabanshi by the petitioner along with other accused persons and dead body of the deceased was found in the well which was tied with towel having heavy weight of stone.
It is submitted by learned counsel for the petitioner is innocent and committed no offence. He has been falsely implicated in this case due to dirty village politics. No one is the eye witness of the alleged occurrence. The petitioner has been

No.25390 of 2023(4) dt.23-08-2023 2/2 made accused in this case on the basis of his self confessional statement before the police which has no evidentiary value in the eye of law. No specific overt act has been made against the petitioner. During investigation, no consistent evidence has come to support the allegation levelled against the petitioner. Petitioner has got no criminal antecedent and he is languishing in judicial custody since 24.10.2022.
The application for bail is opposed by learned APP for the State and learned counsel for the informant. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Rohtas at Sasaram in connection with Sasaram (Darigaon) P.S.
