Having regard to the fact that the petitioner was an employee of Menglore Tiles Production, Darbhanga, he cannot get the benefit of first and second time bound promotion in view of specific decision of the Khadi Board that such payment will be made only on the basis of profit and loss statement of those organizations.

In that view of the matter, this Court does not find any merit in this application. It is, accordingly, dismissed. (Mihir Kumar Jha, J) surendra/- U
