The instant application for anticipatory bail has been filed by the petitioners apprehending their arrest in connection with Arer P.S. Case no. 84 of 2021 instituted for the offence punishable under Sections 341, 323, 324, 325, 354(A), 379, 504 and 506/34 of the Indian Penal Code.

As per allegation in the FIR, while the informant was going towards his field, several accused persons including the petitioners started to assault him in the way resulting into severe injuries in his body. When his sister Ranjana Jha came there for his rescue, she was also beaten up by them with iron rod. And petitioner no. 1 had snatched his gold chain from her neck.

General and omnibus allegation has been levelled against them. Both petitioners are ladies. Specific allegation of assault against co-accused Phul Jha and Akash Jha. Both the parties are next door neighbour and there is land dispute between them. There is case and counter case.

Learned APP appearing for the State has opposed the prayer of Bail.

Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioners on bail. The petitioners are directed to surrender in the Court below within a period of four weeks from today and in the event of their arrest or surrender in connection with Arer P.S. Case no. 84 of 2021, they will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJMIII, Benipatti, Madhubani subject to the conditions as laid down under section 438(2) of the Cr.P.C.
